These terms and conditions relate to and govern the Blackhearts & Sparrows website and Blackhearts & Sparrows Personal. Please read this and the Privacy Policy before using the website. By using the website, you are accepting and agreeing to these terms and conditions.
BHS Richmond Pty Ltd (“we”, “us”, “our” or “Blackhearts & Sparrows) reserve the right to change these terms and conditions at anytime without notice.
Our online store operates under BHS Richmond Pty Ltd ABN: 17 483 677 847. Victoria Liquor License: 32064953. Victoria Liquor Control Reform Act 1998: It is an offence to supply alcohol to a person under the age of 18 years (Penalty exceeds $17,000) and for a person under the age of 18 years to purchase or receive liquor (Penalty exceeds $700).
Orders
- All orders placed on the website must only be done by those 18 years or older in accordance to Victoria Liquor Control Reform Act 1998.
- All orders placed on the website intended as a gift, must confirm that the recpient is 18 years or older in accordance to Victoria Liquor Control Reform Act 1998.
- All orders including those taken over the phone will be accepted at Blackhearts & Sparrows Wine Purveyors sole discretion.
- You will receive a Customer Order number specific to your purchase, signifying Blackhearts & Sparrows Wine Purveyors acceptance of the order.
- Vintages and prices can be subject to change at short notice, but any change will be clearly communicated prior to order processing. Bottle shots used to advertise products may show different vintages to those that are currently available. If you’re unsure about a product, please email us prior to purchasing.
Price & Payment
- All orders are priced in Australian Dollars and include GST.
- All prices quoted on the website exclude postage and handling costs. You will be charged extra for postage and handling. You will be notified of these extra costs at the time you place your order.
- Prices quoted on the website are subject to change at our sole discretion without notice.
- When you place an order on the website, you authorise Blackhearts & Sparrows to deduct payments from the credit card you provide.
- You must be the authorised credit card holder or be authorised by the credit card holder in order to have payment details processed.
- Blackhearts & Sparrows can refuse to authorise and process an order with absolute discretion when deemed necessary. Blackhearts & Sparrows may request credit, anti-fraud and identity checks if deemed necessary.
- Blackhearts & Sparrows uses PCI compliant payment provider SecurePay to offer secure payment to protect you in accordance with industry practice.
Discount & Promotions
- We offer 10% off orders for 6 or more bottles of mixed wine, please note that specialty, limited or rare wines may be excluded from this promotion at our discretion.
- We offer 10% off orders for 6 or more bottles of mixed beer please note that specialty, limited or rare beers may be excluded from this promotion at our discretion.
- Our 10% discount is not applicable on spirits.
- Our 10% discount is not applicable on a mix of wine and beer, the discount is only applied to products within the same category (e.g six wines, or six beers. Not 3 wines and 3 beers)
- Free Shipping is applied after discount and not applicable for orders being delivered within our Same Day Delivery radius.
- All promotions are automatically applied at cart.
Cancellation of Orders
- All orders are subject to stock availability. We will promptly refund the full purchase price of an order to you should the requested merchandise become unavailable.
- Blackhearts & Sparrows Wine Purveyors reserves the right to cancel any order, at which time we will immediately notify the customer of this action by email or phone using the details provided. We will provide a refund using the original payment method.
Returns
- Our Returns Policy is in accordance with Australia Consumer Law and provides you with additional benefits in addition to those rights, because your satisfaction is important to us.
- Your rights under the Australian Consumer Law:
- 'Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and for compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.'
- Please note that once your order has been accepted & dispatched by Blackhearts & Sparrows, we will not accept change of mind returns or exchanges on merchandise.
- In the event that your purchase is faulty, damaged, wrongly described or breaches a consumer guarantee we will cheerfully refund your money or exchange the product upon presentation of your proof of purchase and at least ¾ remaining of the original faulty bottle. Please contact [email protected] for arrangements to be made, or alternatively head into your local Blackhearts & Sparrows store.
- Delivery charges will be reimbursed to you if Blackhearts & Sparrows are at fault i.e. faulty product, incorrect product delivered, or products damaged in transit. In all other instances including change of mind the delivery charge will not be reimbursed.
E-Gift Cards
- Gift Cards purchased via our online store are delivered via email. Physical gift cards can be purchased via any Blackhearts & Sparrows store.
- All gift cards are valid in Australia Dollars.
- Gift Cards are valid for three years from the date of issue unless otherwise required by law. Gift Cards should be treated like cash. Any remaining balances will be retained on the gift card, and cannot be redeemed for cash. At expiration date any unused balance will not be refunded or credited.
- Gift Cards cannot be discounted.
Dispatch & Delivery of Orders
- Blackhearts & Sparrows aims to dispatch all orders received within 24 hours. Orders received on weekends & public holidays will be dispatched the next business day.
- During promotional periods there may be a delay in dispatching your order, however Blackhearts & Sparrows will take every measure to ensure the prompt dispatch and delivery of your order
- Blackhearts & Sparrows uses reputable postage services (in most cases Australia Post) to transport your order to the delivery address selected by you. Each parcel will be insured, with the maximum insurance value being $1000.
- Next Day & Same Deliveries that are within a 12km radius of Melbourne CBD are carried out by our friendly Blackhearts & Sparrows team who are required to check and verify an evidence-of-age document for all new Blackhearts Online and giftee customers.
- Due to recent changes to the Liquor Control Reform Act 1998 (the Act) we can only leave your parcel unattended if you order not a same-day order, you are an exisiting Blackhearts Online customer AND have provided authority to leave.
- Blackhearts & Sparrows makes every effort to pack all parcels securely, however due to the fragile nature of the merchandise if you do receive a damaged parcel please notify [email protected] immediately so that arrangements can be made.
- Given the nature of Blackhearts & Sparrows merchandise, orders will not be sent in exceptionally hot weather. If there are any foreseen delays you will be notified promptly.
- In the instance that you provide an incorrect delivery address, Blackhearts & Sparrows Wine Purveyors will not be responsible for any loss or damage suffered if your order is delivered to the address that you have supplied.
- Please note that all delivery and shipping fees are non-refundable unless a Product fails to comply with the Australia Consumer Law consumer guarantee provisions.
- For deliveries to South Australia: as per the South Australian Liquor Licensing Legislation 2019 amendments, you agree that the recipient of the delivery is required to sign a declaration confirming their name and that they are aged 18 years and over. If the recipient looks under 25, they will be required to provide proof of age identification (photographic ID and date of birth), which will be recorded and held for a minimum of 12 months. If the recipient nominates an alternative person to collect the delivery, their details will be kept as a signed declaration.
Bottle Drop
- Bottle Drop is a subscriptions service brought to you by Blackhearts & Sparrows
- At the time of placing your subscriptions your payment details are processed securely via payment gateway (SecurePay) is PCI DSS (Payment Card Industry Data Security Standard) compliant.
- Blackhearts & Sparrows is not able to access or amend your credit card information relating to your subscription. This can only be done by logging into your account and updating via the Subscription Payment tab.
- Your subscription will be sent to you at the frequency at which is selected at the time of placing your order.
- For active subscriptions your payment will be processed on the 27th of the month.
- Your subscription will be dispatched in the first week of the month. We aim to have all deliveries finalised by the 5th of the month. If that happens to fall on the public holiday or weekend we will dispatch your subscription the next business day.
- If you selected ASAP, your order will be packed within business hours and dispatched to you, and an email with confirmation of dispatch and tracking will be sent so you can monitor the process. If you select ‘Next Month’, your order will be delivered in the new month. (For orders placed after the 28th, you will receive the new upcoming pack)
- You can Pause, Cancel or Edit your subscription any time by logging into your account and selecting from one of the options.
